The Legal Challenge - Toll Roads
Robin Hood has launched the first constitutional challenge to Australian toll roads post Vanderstock v Victoria, and it goes straight to the heart of section 90 of the Australian Constitution.
The argument is simple, but it cuts deep: if tolls are, in substance, a charge on the use of roads by the public, they may be an excise, and under the Constitution, States cannot impose them.
That turns a “user pays” system into something far more serious: a potentially unlawful tax embedded in everyday life, backed by enforcement and penalties, and unavoidable for many Australians.
This legal challenge asks the High Court to decide whether toll roads are what they claim to be, or something else entirely.
